Terms of Service

Important: This service organizes participation in spiritual and cultural rituals. It does not sell or promise medical treatment, psychological care, financial improvement, legal outcomes, supernatural effects, or any guaranteed result. These template terms must be reviewed by qualified French and U.S. counsel before commercial launch.

1. Agreement to these Terms

These Terms of Service (“Terms”) form a binding agreement between you and , trading as (“we,” “us,” or “our”). They govern your access to the website, waitlists, checkout, ritual-participation services, private post-ritual guidance, customer support, and related communications (collectively, the “Service”).

By selecting the consent checkbox, placing an order, joining a waitlist, or using the Service, you confirm that you have read and agree to these Terms and the policies incorporated by reference. If you do not agree, do not use or purchase the Service.

The following are incorporated into these Terms: the Subscription Terms, Refund and Cancellation Policy, Privacy Policy, Cookie Policy, Spiritual Services Disclaimer, and, where relevant, Travel Terms.

2. Contracting party

The contracting party is , a , with registered office at , registered under , VAT number , share capital . Additional mandatory notices appear on the Company Information page.

3. Nature and scope of the Service

The Service arranges for a participating practitioner to include the customer’s submitted name, portrait when requested, and personal intention in a ritual or ceremony described on the order page. Unless expressly identified as private, an advertised full-moon ritual is a shared ceremony in which multiple customer submissions may be included.

You purchase organization, administration, practitioner participation, and the described private post-ritual written guidance. You do not purchase a particular belief, outcome, blessing, change in fortune, cure, diagnosis, treatment, or prediction. Ritual terminology describes the nature of the cultural or spiritual activity and is not an objective warranty of efficacy.

Descriptions, dates, practitioner biographies, capacity, guidance format, and location information shown at checkout form part of the applicable order. Promotional imagery may be illustrative unless expressly labelled as footage of the specific ceremony or practitioner.

4. Eligibility and capacity

You must be at least 18 years old and legally capable of entering a contract. You must use the Service for yourself or have valid authority and consent from each person whose name, image, or personal information you submit. The Service is not directed to children.

You may not purchase or use the Service where doing so is unlawful. You are responsible for checking restrictions applicable in your location. We may refuse or cancel an order where required by law, sanctions rules, payment-provider rules, practitioner safety, cultural restrictions, fraud prevention, or capacity limits.

5. Orders, prices, taxes, and payment

Prices and billing frequency are displayed before checkout. Unless stated otherwise, the recurring Full Moon Ritual is USD $80 per month. Applicable taxes may be calculated at checkout. Your payment method is processed by Stripe; we do not receive or store your complete card number.

An order is accepted when payment is successfully authorized and we issue confirmation. An acknowledgement of submission alone is not acceptance. If a displayed price or material description is clearly erroneous, we may cancel before performance and refund amounts paid.

You authorize the payment provider to charge the amount and frequency clearly displayed at checkout. The descriptor on your statement will be the descriptor configured for and may be abbreviated by your bank.

6. Automatic-renewal subscriptions

A subscription renews automatically each month until cancelled. The price charged today, renewal cadence, service included each month, and cancellation route are presented immediately before payment. Full rules, including renewal, failed payments, changes, and cancellation timing, are in the Subscription Terms.

You may cancel through the online member page or another method required by applicable law. The single cancellation action ends the current ritual participation, releases its place immediately, and terminates future renewals. It does not automatically reverse a charge already incurred. Refund eligibility and mandatory withdrawal rights remain governed by the Refund and Cancellation Policy and applicable law. We do not impose a minimum term unless one is expressly stated before purchase.

7. Names, intentions, photographs, and other customer content

You retain ownership of content you submit. You grant us a limited, non-exclusive, worldwide licence to host, copy, translate, transmit, display privately to the assigned practitioner and service providers, and otherwise process that content only as needed to provide, secure, document, and support the Service or comply with law.

You represent that your submission is lawful, accurate enough to perform the Service, and does not violate privacy, publicity, intellectual-property, confidentiality, or other rights. Do not submit sensitive medical records, financial account information, government identifiers, passwords, unlawful threats, or content that could endanger a person.

We do not obtain the right to use your photograph, name, intention, testimonial, or ceremony participation in advertising merely because you purchased the Service. Promotional use requires separate, specific permission that you may refuse without affecting your order.

8. Acceptable use

You must not misuse the Service, attempt unauthorized access, interfere with its operation, submit malicious code, automate abusive requests, impersonate another person, test stolen payment credentials, harass practitioners or staff, record a private ceremony without permission, or use the Service for an illegal, deceptive, exploitative, or harmful purpose.

We may suspend access, preserve evidence, or cancel affected orders when reasonably necessary to protect customers, practitioners, collaborators, systems, or legal obligations. Where appropriate, we will provide notice and a proportionate remedy.

9. Scheduling, ritual cutoff, guidance delivery, and changes

Submissions received before the stated cutoff are normally assigned to the next eligible ceremony; later or incomplete submissions may be assigned to a later ceremony. Weather, safety, practitioner availability, local requirements, transport, communications, and cultural considerations can require a reasonable postponement or modification.

Unless the purchased offer says otherwise, the post-ritual deliverable is private written guidance rather than a ceremony photograph, video, name-card image, or individual recording. It is personalized from the submitted intention, ceremony context, and continuity of the member’s private ritual messages. The guidance is not an individual recording or verbatim transcript of the ceremony, a guaranteed prediction, or proof of a supernatural result.

The standard schedule prepares the guidance at approximately 9:00 a.m. in the Lake Baikal time zone on the day after the assigned ceremony and releases it at the first 7:00 a.m. in the timezone saved in the customer account after preparation. Reasonable technical or operational delays may occur.

If we cannot provide the material elements of the purchased service within a reasonable rescheduling period, the remedy described in the Refund and Cancellation Policy applies.

10. Cancellation, account closure, refunds, and EU/EEA withdrawal rights

You may cancel online through Member Access. The single action ends current ritual participation, releases the place immediately, terminates future renewal, generates a dated confirmation, revokes account sessions, deletes active ritual personal data, and de-identifies the operational membership record. Limited records may be preserved only for accounting, tax, security, chargeback, legal-obligation, or claims purposes.

Our voluntary refund rules appear in the Refund and Cancellation Policy. Cancellation or immediate deletion does not automatically refund the current charge, but this does not limit non-waivable statutory rights.

If you are an EU/EEA consumer, you may generally have 14 days from conclusion of a distance service contract to withdraw. If you expressly request performance during that period, you may owe a proportionate amount for service already supplied. If the service is fully performed during that period after the legally required request and acknowledgement, the withdrawal right may be lost to the extent permitted by law. The checkout must not rely on this exception unless the necessary separate express request is actually collected.

To exercise a statutory right, use the online cancellation or privacy controls or send an unequivocal statement identifying the order to . A model form is provided in the Refund and Cancellation Policy but is not mandatory.

11. Intellectual property

The website, original text, code, layout, trademarks, and commissioned media are owned by us or licensed to us. Subject to these Terms, we grant you a limited, revocable, non-transferable right to use the website for personal, non-commercial purposes. No rights in a practitioner’s image, voice, traditional knowledge, ritual, or cultural expression are transferred to you.

12. Third-party services and links

The Service may depend on payment processing, hosting, email, analytics if enabled, translation, local coordination, and other third-party services. Their own terms may apply to their direct services. A third-party link is not an endorsement, and we are not responsible for an unrelated third-party website.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided with reasonable care but without any promise of a supernatural, medical, psychological, financial, legal, relationship, career, fertility, immigration, or other external result. The Service is not a substitute for a licensed physician, therapist, lawyer, financial adviser, emergency service, or other qualified professional.

Nothing in these Terms excludes warranties or consumer protections that cannot lawfully be excluded. The complete subject-specific disclaimer is available in the Spiritual Services Disclaimer.

14. Limitation of liability

Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, wilful misconduct, death or personal injury caused by negligence where it cannot be limited, breach of mandatory data-protection obligations, or any other liability that applicable law does not permit us to limit.

Subject to the preceding sentence, we are not liable for indirect, incidental, special, punitive, or consequential loss; loss of profit, opportunity, goodwill, anticipated savings, or data; actions you take in reliance on a hoped-for ritual outcome; or events outside our reasonable control. For a consumer claim arising from a paid order, our aggregate contractual liability is limited to the amount paid for the affected service during the six months preceding the event, except where such a limit is prohibited or manifestly inadequate under mandatory law.

15. Responsibility for misuse

If you use the Service for business purposes or submit content without required authority, you agree to compensate us for third-party claims and reasonable costs directly caused by your unlawful content, infringement, fraud, or material breach. This clause does not apply to a consumer to the extent prohibited by mandatory consumer law.

16. Events outside reasonable control

Neither party is responsible for delay caused by events it could not reasonably prevent, including severe weather, natural hazards, fire restrictions, illness, civil disturbance, communications outages, governmental action, sanctions, border restrictions, or unsafe local conditions. We will take reasonable steps to notify affected customers, reduce delay, and offer rescheduling or the remedy required by law.

17. Changes to the Service or these Terms

We may update these Terms for legal, security, operational, or service changes. The effective date and version will be posted. Material changes affecting an active subscription will be notified in advance when required, and will not retroactively remove accrued rights. If you do not accept a prospective material change, you may cancel before it takes effect.

18. Suspension and termination

You may stop using the Service and cancel a subscription at any time. We may suspend or terminate access for material breach, fraud, abuse, legal prohibition, or genuine safety concerns. Where practical and lawful, we will provide notice and an opportunity to correct the issue. Provisions intended by their nature to survive—such as ownership, privacy, disclaimers, accrued payment duties, and dispute provisions—remain effective.

19. Governing law and disputes

These Terms are governed by French law. If you are a consumer, this choice does not deprive you of mandatory protections of the country where you habitually reside. Before filing a claim, please contact us so we can attempt a good-faith resolution.

French courts have jurisdiction, subject to any mandatory consumer right to bring or defend proceedings in another competent court. Nothing here requires a consumer to waive a non-waivable right or accept mandatory arbitration. EU consumers may have access to an applicable consumer mediator once the operator has appointed and identified one on the Company Information page.

20. General provisions

If one provision is unenforceable, it will be limited or removed only to the minimum extent necessary and the remainder stays effective. A delay in enforcing a right is not a waiver. You may not transfer your contract without our consent, but we may transfer it as part of a merger, restructuring, or business transfer if your rights are not reduced. These Terms and the incorporated policies are the complete agreement concerning the Service.
